When we collect, use or disclose personal information, we do so in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act). If applicable, we also control and process data in accordance with the principles set out in the General Data Protection Regulation (GDPR).

What personal information do we collect, why do we collect it and how do we use it?

The information we collect from you may include your name, address, telephone number and email address, transaction details associated with your purchases from us including credit card details, details of your use of our website including your server address, domain name, type of browser, date and time of your visit and pages accessed and any additional information provided to us or our affiliates. We may also collect sensitive information (such as information about your health and medical conditions), which we will only collect with your consent. We may also collect information about you because we are required or authorised by law to collect it.

We collect personal information so that we can provide you with information, our products and services, and seek to improve your customer experience. The ways we use personal information include:

Where we use cookies, we do so to enhance our customers’ experience on our website and to track user traffic. Cookies can only store personal information which you provide yourself. Access to your personal information

You have certain rights under the Privacy Act to request access to personal information we hold about you and to update or correct that information. If you would like a copy of the information we hold about you or if you believe that any of the information we hold about you is out of date, incorrect or otherwise requires updating, please email us at shaun@fairwayperformance.com. A small administrative fee may apply where you request a copy of information.

If the GDPR applies, you may also:

  • request that we erase personal information we hold about you or request that further processing of your personal information is restricted or suspended,

  • request that we forward your personal information to a third party,

  • withdraw your consent for us to use your personal information,

  • object to your personal information being used in direct marketing.

Complaints about privacy

If you have a complaint about our privacy practices, please send details of your complaint to us in writing at shaun@fairwayperformance.com. We take complaints very seriously and will respond to you shortly after receiving your written complaint. 

If you believe we have failed to adequately respond to your complaint, you may be entitled to lodge a complaint with the data protection authority in your country (if one exists) or a relevant supervisory authority such as the Office of the Australian Information Commissioner by calling 1300 363 992 or by writing to GPO Box 5218, Sydney NSW 2001 or enquiries@oaic.gov.au.

Consent

By using our website, our products or our services, you consent to the collection, use and disclosure of your personal information (including sensitive information) in accordance with our Privacy Policy.

When you give us personal information about someone else, we rely on you to make that person aware that you will give us that information, the ways we may use that information, the circumstances in which we may disclose it and how that person can access the information. You can choose not to receive product and service offerings from us by notifying us in writing at shaun@fairwayperformance.com If you do not provide the information we request, we may not be able to provide you with certain products or services.
